Worst experience ever. Spent 6 hours at dealership. When I entered the finance office to buy a brand new car, they added $2k+ worth of accessories to the initial contract and I told them to remove it or deal is off. They removed the additions and I signed and left.
I have copies of the initial and the actual contract that I signed.
Fast forward to today, I created an online account on the manufacturer’s website and it appears that the finance dept submitted the Initial contract instead of the one I signed. Is there anything that I can do? I suspect that they transferred my signature from the latter contract to the initial one so that the 2k+ worth fees are still included.
If you have the actual contract you signed, they have to honor it. I don’t think you need a lawyer. If it comes to it, you can take them to small claims court but I really don’t see them fighting this.
Are you in possession of those $2K+ accessories at all?
With a signed contract an eager plaintiff’s attorney can probably write a letter threatening to demolish the dealer for like $150. I’m just saying it doesn’t hurt to call.
The “accessories” are car alarm and paint protection. Surprised I still need aftermarket “alarm” on a 2023 Lexus that has gps tracking and Lexus security system
I am going to bet that the initial one you did not sign now has signatures. I would send an email to the GM, GSM, the new car manager, and the FI manager asking why the wrong contract was submitted and how they plan on fixing it. You can also ask Lexus Financial for a copy of the contract that was submitted (do not mention why, just say you lost it or want it for your records). In the meantime, I would start researching some attornies in your area who specialize in the automotive field. Also, I think in CA you can cancel any and all extended warranties/accessories within 30 days, but double check that.
This is what does not make sense to me though. Let’s assume you did a long-term lease at 42 months. $10 a month is only $420. Where did the other $1600 of accessories go? Unless the $10 is from something else (i.e. local taxes that should have been in the contract) that the dealer missed. Either way, get the contract that Lexus Financial has and review it.
The initial contract has 2k+ added in accessories but a much lower money factor.
The contract I signed does not have accessories but includes loan shark rates money factor(which I don’t care because I’m buying out the lease shortly).
I don’t know if this explains the $10 difference or not.
Monthly payment is $10 less on initial(bad) contract yet gross cap is much much more compared to the contract that I signed.
What’s also weird is that it usually takes 2-3 days for a Lexus online to be created after taking delivery of car(at least that’s my experience). This one took 2 weeks to gain online access.
So your car has those accessories, right? It might make things more complicated and for $10 / month, it might not be worth your time / money pursuing it.
The fact that your car has those accessories can make the situation complicated. I would try to work it out with the dealer and if it doesn’t work out, it might worth getting a legal opinion. Laws can be counter intuitive. Also legal fees add up very quickly and small claims court may be a good option. The dealer will want to work this out as well. Nobody wants to deal with the legal system.
Turns out the contract that the dealer submitted to Lexus Financial is NOT the same as the one I signed.
According to yelp, other people have incurred the same problem with this dealership.
I’m waiting on resolution but have a bad taste about all of this. I want to work with a more reputable Lexus dealer. Can I just void the contract and return the car or is this not an option?
