Punched car not disclosed

I wouldn’t take a budget third party warranty here.

If they sold a punched unit as new and didn’t disclose they possibly broke code (or at least standard acceptable practices—FL is the Wild West so who knows?). I’d get creative and really bend them over a barrel for a great outcome for you.

Among other things, they have potentially diminished your future upside opp and value on the car, and will have to handsomely compensate you for their mistake and/or fraud. Don’t restrict your view of being made whole to the warranty.

My key at this stage would be to get a written admission of what they did so you can build your compensation strategy around that. But don’t ask for that directly—keep it calm and casual and friendly and let them bury themselves while you smile kindly.

I have been friendly, understanding and above board. you are correct about diminished value. It smells of fraud/deception to me…

Doesn’t always work that way, he would have to follow the law of his state, and if it was sold used he’d have an even harder time twisting arms, just saying

Well the GM’s desire to remedy the issue seems to be tantamount to an admission of error, so I don’t believe it was sold as used. That would lead me to believe the OP has cause for action, if he chose to go that route. A buyback at current wholesale value with a nice discount on a new car would be a good resolution in my view.

Even if the gm says that,if OP signed something that says he knows its used he might be SOL

Paperwork trumps verbal

OP, what exactly does your paperwork say about new vs. used car? Again, a scan would be helpful for posters to review.

Correct but why would the GM assure OP that the car wasn’t punched, and be actively trying to provide a remedy IF the OP signed a document stating the car was sold used? The GM would have access to the paperwork and if it was sold as used/demo at the time, he would state it as such to avoid liability.

Doesnt matter what he says, thinks, or implies, paperwork trumps all. And i bet hes still looking for it or is just trying to give a helping hand to the OP.

I bought a car with an undisclosed accident that appeared in carfax when i tried to sell it. I went to the dealer where they produced the original carfax where the accident was not listed, so their paperwork trumped mine because it wasnt there when i bought the car, so they had nothing to disclose

I take it you bought a used car? In which case, the dealer can claim plausible deniability if the accident didn’t occur on their watch. But the OP states the buyers order lists the car as new and the GM is being forthright in seeking a remedy. That tells me that the OP has leverage. But sure, seeing the documents ourselves would be helpful.

Yes it was a used car and yes it happened before they bought the car from the owner, somehow the original owner kept it out of car fax for 3 years.

OP states the car was new, verbal means nothing, if the paperwork says the car is new, that dealer is in trouble, assuming its the same dealership owner, but if the paperwork says used, OP might have misremembered a fact from 3 years ago. Thats why we keep asking for paperwork. We can speculate on verbal forever, but a simple piece of paper wins all arguments

And i dont think the GM is forthright, hes just trying to get a upset customer off his ass

Simplest thing seems to post redacted paperwork for the pros here to decipher.

If it’s not driveable, have them tow it to their dealership, fix it, and send it home wrapped in AudiCare. If it is, I’d still take it there and let them deal with it.

Unless you signed a disclosure that said the warranty ended (whatever 3 yrs from the punch date is), then what they’re offering is a courtesy — and I’d go out of my way to take it there and let them sort the repair, and expect it home without a warranty.

Audi Corporate is very unlikely to eat this if it was punched, which means no other dealer will either.

If this was a legitimate mistake, the dealer has a rep from the manufacturer whose job it is to help handle situations like this.

If their Audi rep was a viable avenue for the dealer to correct this, they wouldn’t be screwing around with the same third-party warranties they sell to naive / clueless used-car customers in the finance office.

Why would your current vehicle not be eligible for an Audi extended warranty if this was just an honest mistake?

the car was sold as “NEW” as stated on the buyers order with 22 miles on the odo. It was never sold as or represented as used. The car is out of mfg warranty so they will have to work some voodoo magic to get it an Audi extended warranty, which would be the best outcome. I doubt this is the first time this has happened at this dealership with these air bag sensor stop sale cars from 2019.

I might have missed something. I thought you were saying that if it had actually been new as represented when you got it, it would still be under the original factory warranty.

But what is the definition of “new” in your state?

In many states the legal distinction between new and used is whether it has been titled or not. It’s got nothing to do with number of miles on the odo.

Which is why people can/could apply new car lease programs to demos, loaners, brasshats, etc.

And new cars being punched to clip an expiring coupon is nothing new either.

Back in 2008 Audi of America was able to change the warranty expiration date for me, any OEM should have the ability to do that if it’s a genuine mistake. But be prepared for the possibility that the car really was punched 5/18 and the warranty genuinely expired 5/22.

I think the only path to resolving this issue to have the repair done at the dealer you bought car from. Drive it over and ask for them to pay for your Uber home or have them tow the car. Whether they fix the car through Audi warranty or on their dime, they need to make it right for you

I do believe the car was punched and the warranty expired 05/2022. the selling dealer is 135 miles away. the selling dealer did offer to pickup the car and fix the problem but this dealer screwed me once, why would i let them do it again but it may be my only option.
