That’s not jalopnik.
You would think the Kia regional reps would find this out much sooner. That is if Kia even has them
I genuinely don’t understand how this is even possible. Once the VIN is sold, how do they sell it again later? How many people need to be in on fraud at this level to do it across multiple dealerships?
The sales manager name was Jerry Lundegaard?
2022 was a weird year for car market when used cars sometimes were more expensive than new. I can totally imagine he was planning to get away with it by selling these KIAs on user market.
And interesting as the dealer owner started from nothing, amassed a handful of dealers in his 30s then flipped all but one. On the outside a success story but some shady dealings may have made it happen.
Kia America has accused a New England car dealer of falsifying retail records and pocketing hundreds of thousands of dollars in ill-gotten sales incentives.
In a federal lawsuit filed in New Hampshire last month, Kia alleged Dan O’Brien Auto Group and its top management submitted hundreds of fraudulent retail delivery reports for vehicles that hadn’t actually been sold to customers.
The lawsuit names six current and former O’Brien dealerships in New Hampshire and Massachusetts, as well as auto group CEO Dan O’Brien and COO Tom Kuhn. Hurling allegations of racketeering, fraud, conspiracy, and related claims, Kia accused the dealerships of shuffling inventory around to mask the purported deception.
I recently went to purchase a Kia in socal and they told me they didn’t have a car on the lot and they had to go get one for me and I waited two days and finally he called and said the vehicle was ready for me. 2023 Kia sportage 40,103k miles on it for 24,250 I out 2k down and signed only to find out after I signed all the papers that it didn’t come with the hundred thousand mile warranty that Kia offers when you purchase a Kia vehicle and that I would have to purchase an additional warranty so I did that I added it to my financing and my financing ended up at the end $32,000 and then he put my 2000 down payment and deducted it so it was 30,503 weeks later I find out I’m not driving a Kia certified vehicle. I’m driving an enterprise vehicle with some Hinky Fidelity maintenance warranty and I am on a 84 month term with Capital One auto financing Payments of 514 a month at the end of the 84 months I will be paying $45,000 for a used dinged up ENTERPRISE (I really believe it’s auction or junkyard with the parts that are on this car) vehicle that I could have purchased at enterprise myself for the same price this guy did. I got SWINDLED and i need help. What can. I do to fix this?! TIA
This didn’t alert you that it was a rental?
How long ago did you do the deal? You should be able to cancel the warranty and maintenance plans for a refund at least and find better deals online for the same coverage.
Oct 16th 2024. They had me sign a bunch of papers and everything he printed out for me is NOT what I was sitting there signing. They didn’t even tell me how much of a loan they requested in my name they just didn’t and then added all these things that I was under the impression came with the purchase.i am screwed. But the point is i could have gone to a 3rd party like I was planning to and when I told them that I wasn’t gonna pay more than 21 for it because that’s what I can get it for at Carvana. The salesman told me that yeah but you won’t have Kia‘s great warranty and so he said that’s why we priced at 24 so I said OK. You’re right it comes with the warranty that makes sense, I’m an idiot
He went to enterprise and purchased this vehicle and sold it to me for twice it’s worth
Did you not check the Carfax before buying the car?
You’re stuck with the car but you can cancel the service contracts before the 16th.
Guide to Auto service contracts.
More reasonably priced extended protection can be found online if you do want an extended warranty.
What has you coming to LH, complaining about a contract you had signed, nearly a month later?
The main issue here is that you either didn’t understand what you were signing or you simply didn’t read it. Especially the monthly payment at the 84 month term. If you’re going to glance at anything on the contract, one would think that would be it.
What kind of dealer would stoop to something like this. Is this a large brand dealership or a one-off (Greasy Pete’s Used Cars)?
It’s a Kia dealership. It was my first time and I had gone with a close family friend as it was his recommendation and he told me he would take care of me knowing my situation. I have two kids and I trusted him. He told me there was no other Sportage on the lot and I asked if there was anything similar to the Sportage and he said no I told him I wanted it all-wheel-drive he said OK and I told him I wanted to moonroof. Those were my my specifications and he said okay. Finance guy just had this stack of papers and was talking fast and holding the edges of the papers and flipping them telling me where to sign after giving me a brief description of the page. He didn’t have any numbers printed on them and when I see what they copied for me there are crazy things like a. I’ll of sale that I know I would have noticed he didn’t even tell me the amount asked for loan. Why would capital one approve a loan for that much when my own bank approved 23,7 after assessing the value of the vehicle. They didn’t even tell me, Chase’s offer they didn’t even tell me any offers or anything.I DIDNT EVEN TEST DRIVE I appreciate all your advice
You can also refinance the loan to a lower rate with your bank or a credit union.
