I’m on vacation and dealer says now they don’t want the car

If I were you I’d probably just not respond and enjoy your vacation. You don’t owe them anything. They owe you a check.

This happened to me once.

After I dropped a car off and signed paperwork they told me they don’t buy leases.

In that case, it wouldn’t matter as it would be an internal business issue. OP wouldn’t be responsible as long as the dealership employee signed all the paperwork. Now here’s the “if”. OP doesn’t have the check it seems like. Which means OP is in a tough spot. Remember there’s the law and there’s reality. The law says speed limits are XX. Reality means we live our lives a quarter mile at a time (I’m from NJ)

FYI, this law gives the dealer an additional remedy for voiding a vehicle sale

A vehicle sale “may be voided by the buyer if…”

But it’s not exclusive. That would be

A vehicle sale “may only be voided by the buyer, if…”

So, not particularly applicable to OP’s situation, unless that’s the basis for their return, but it doesn’t sound like it is.

Since it sounds like OP did this deal at the dealer, there shouldn’t be any codified cooling-off period (weird MA exception for door to door sales), so it’ll all come down to offer and acceptance language in the agreement.

Yeah I don’t have a check. But this is a National dealer group so I’d assume they have a process they have to honor.

Literally sold another same spec Rubi 2 weeks before same price to one of their other stores (90 min away) and got the check fedexed day after paperwork signed. Same paperwork too.

I’ve sold before where I waited for check until they got title. Happy to wait when I know they’re good for it.

Honestly if they took possession I’d refuse the return.

I would just ask them politely to send you the clause in the agreement that lets them unwind the deal.

Dealerships don’t always stay between the lines. I don’t care what kind of label you want to summarize the events with. Whether it was an internal issue or not, the GM wants the deal reversed.

I’d love to buy a car from this dealer and then return it after a change of heart on taking delivery. I bet there’s a different contract for selling, than buying.

The fact that they were so up front and detailed were about their purely convenience reasons for unwinding makes me think they either

  1. Have never done this before and are just trying to see what happens; or
  2. They do this every day.

Curious to see which one it is.

This was at worst 2k overpay. (I know this because I had five other offers at 50k on my Jeep.) can’t hurt for them to take a flyer on me taking the bait and unwinding it easily. But I’m
not taking that bait.

I’m a previously happy customer with glowing google review, also happy to let it slide if they honor original deal, and it will be a total pain for me to reregister and insure my car and sell it again. At which point I will find every possible venue to share my negative experience to anyone looking to do business with them.

if the dealer had balls, the actual GM would reach out not his sidemen. Its probably just a ploy to get out quick on their end and if all goes the hell, you’ll quickly find an email saying “the employee was terminated”

And I would respect that. If the GM called me the day after the deal not an email 4 days later I’d try to work with them.

The BDR who I worked with who has been there a while is probably the one getting in trouble on this one which is unfortunate as she’s a good one and helped me get this done efficiently.

And it’s not like they paid 20k too much for an exotic that has a blown engine. It’s a new Jeep almost 10k under sticker and 1700 under Mmr at the beginning of summer.

Some new data from Manheim transactions, this could be the possible reason for the trigger. They probably think that they cant even get 50k from Manheim.

Equity in used cars is drying up as the federal reserve has raised rates 10x in a row. Predictions are for a significant 5% drop in used car prices for the month of june in next cpi report.

First of all, this sucks! No two ways about it. It sucks even more that you got this email on vacation and not via a phone call the next day (as others have said) from somebody very high up at the dealership. 2nd, how does this work with your CCAP lease? If CCAP has never received the payoff, then the lease is still considered active? Please keep us in the loop. Try to salvage and enjoy the rest of your vacation.

Yes, lease would remain active until CCAP receives the payoff, but States do have the rules for the car dealers. Eg. in FL, dealers are required to complete the payoff within 10 business days else they can be held liable to pay for the damages, etc.
