Where have you said they are going to keep the deposit? Have they said that to you directly?

They agreed to sell the car for X w/ the $1300 extended warranty - nowhere did they say you can remove that and they’re ok with it… hell they said the opposite w/ the $5 per month discount.

I’m not saying this is an easy situation but they owe you X back and you owe the a car back.

Just get it over with so you can move on and get the car you want.

Although I understand you have your brother’s best interests at heart, I think you ought to tell him the consequences of playing hardball with the dealer. If they repo his car he’s not going to be able to lease another one over an extended warranty. I have no clue if he knows this or not but its best to keep him informed.

On the extended warranty it states my brother has the right to cancel for a full refund within 30 days and he requested that. If the dealer had simply done that the payments would have stayed the same nothing would have changed the only thing would be that nmac would have seen a payment for $1300 for the refund of the warranty. But that didn’t happen they want to change the contract they can’t just decide to change the terms of a contract because they’re not making as much money as they thought.

I made a lot of really dumb financial choices at 18 and all were far worse than $36/month. It sounds like your brother was very proud of his purchase until you pointed out the mistake. Let the kid enjoy his first big purchase and write it off as a lesson learned in adulthood.

We plan on resolving this by next week when the Amex refund comes in. The car will be returned.

Yes, but they’ve already come to your house. Next time it could be a flatbed. Should be done asap

Actually the issuing party can void the contract.

You can take them to court if you would like and see what the judicial outcome would be…

If you’ve already disputed it w/ AMEX, just return it and document it.

AMEX should refund you.

All they have to show is the attempt @ repo to post it on his credit.

Hell, legally, they requested it from you already and you’ve declined.

So why would they need to remove the warranty?

Did consult a lawyer before anything that’s why we called his “calling the police” threats a bluff and told him to call the cops, which never happened. He can’t do anything. All he has to do is fix the payment to what it should be without the extended warranty and we sign the new contract or give back $500. He wants us to bring the car in and swipe the credit card to issue refund which is an excuse to just have my brother walk in because they can just issue a refund without swiping.

It doesn’t remove the warranty it would refund the warranty which is a separate contract in itself. That’s why the payments shouldn’t change if he simply cancels the warranty just a payment to nmac

No… resigning the contract would be removing the warranty.

If you’re able to refund it (which I’d imagine you can), you should have done so using that mechanism.

I can tell you’re frustrated and I get it - it’s daunting to deal with this and it’s your little brother. Plus they (dealer) sound like clowns to begin with.

However - I have a ton more experience here. I have sold several hundred cars and brokered many more… you’re playing with fire.

I have repo’d clients vehicles before and all of them were in your shoes, They were adamant that the dealer can’t do this or was going to screw them and all it got them was a negative mark on their credit.

It’s also a perfectly reasonable request to have you come in and swipe the card for a refund.

I guess I’ll go in on Monday with him and see what they say. That’s if they’re willing to speak with me, on the phone won’t even talk to me I know they don’t have to but they don’t even want me in the background while they talk to my brother.

was the lease term greater than that?

if not, an extended warranty is superfluous and should not have been sold
