They made a mistake, we all make mistakes. The issue is, based on your account, the dealer is not handling their mistake very well.
@Usman_Akram donāt expect anything from Nissan consumer affairs. They donāt own the dealerships not do they have any say in their operations. They only supply the dealerships with product to sell. They donāt really care.
Them telling you āwe will investigateā is just to make you feel better that something is being done but it goes right in the trash. Been down that road with BMW.
That what I told them, fix the mistakes and we wonāt have any problems but then to yell at a 18 year old on the phone using profanity and then to show up at his doorsteps and banging on the door is just not acceptable
I donāt expect them to do much, but I do want to know who the monthly payments are going to go because nmac still has no info they checked the vin number and it shows itās not sold so idk going to have to wait and see what happens.
Just keep doing what youāre doing. Get the refund, turn the car in, and go buy somewhere else. MOST LIKELY, they gave you a good deal to make their quota (as it was May 31st), and now at your request wonāt change it because they donāt have another quota for a few weeks and will try to squeeze extra profit out where they can

So having read through all of the comments and post, here is my .22c (Since Iām taking it from @Ursus)
Legally, the vehicle is still the dealerships. I donāt care what the finance manager you spoke to said, since heās wrong. The vehicle is owned and under the control of the dealership until the financial company funds the deal. Hell, even after that they can still unwind the deal to back out of it, should they choose to do so.
The vehicle being āregisteredā with the state is irrelevant since they can just unwind that too. Itās usually a form the ābillerā (office staff) does once every blue moon, since unwinds happen from time to time.
My crystal ball (since Iām borrowing @vhooloo s) is that they sold you a vehicle w/ X profit in it and now donāt have the same margin w/ you wanting out of the backend product. That also would explain the pricing difference you mentioned.
The backend rejection makes no sense either as they get an amount they can push into the deal when, the structure is sent to the lender. If theyāre using Routeone or Dealertrack, itās literally a prompt that tells them w/ the approval.
I cannot comment on the discussion you or your brother had w/ them beyond the fact that Iām not surprised. Dealerships donāt employ Rhodes scholars for a reason ā¦ youāre going to have some bad eggs.
Now here is the thing, since they came to your house - legally they can take the vehicle and it would show as a repossession on your credit. You refused to return a vehicle and they can hold you to that. An actual pro tip for everyone here is that if you miss your first payment, the dealership has to eat it and itās on them to repo the vehicle. The financial company just voids the contract since they expect the dealer to vet the customer.
Just drive the car back and walk away from this deal. Get them to put in writing that the deal is dead and you have no money due but they owe you the $500.
Do not turn over the keys before that - as they will most likely tell you that the $500 is going to cover the mileage charges since heās driven it.

We did agree on giving the car back once we get a refund not before that told them donāt care what they say they can easily refund the money in one day through whatever credit card merchant they use. Interesting how a dealer can change a āusedā car back to ānewā car because they messed up but if a consumer wants to change something itās a big no no the contract is binding then and the consumer canāt do anything. Iām going to makes sure we put a couple of thousand miles on the car before we hand back the car. Thank god at least AMEX takes their customers side and has agreed to return the charges as long as we have proof that we were suppose to get it back(text messages and voicemail of the manager agreeing should be enough they said).

Then the dealer will show you maliciously placed miles and took your time giving the car back. With that being the case. Amex will take away the refund. Give the car back after you get it in writing they are giving you 500 and absolve everything else. Then go get another car at a different dealer for same deal as before without warranty. Make your life simple instead of more complicated
Agreed you go down with brother nearby and on phone. Bring in a pre typed letter for them to sign and date with your brother signature. Have gm sign it. Have your brother bring in car. Done. Go get another deal. Iāve been through the credit card dispute. Amex does not always side with customers.

What are they getting away with? You wanted something out of a contract and they removed it - they asked you to resign and youāre fighting it.
You think the contract value should be X and they think it should be Y. Theyāve asked for the vehicle back and you want your money back.
I fail to see the mistake too. You bought a deal @ X and they sold it , youāre the one changing the narrative.
Again - I donāt have a horse in this race. Just bring them the vehicle and donāt turn over the keys until they put in writing they wonāt charge you for the mileage and will refund the $500.
Sounds like this dealer is the type to box the car in with another car or jump on the hood if they donāt agree to the terms and want to keep the car that badlyā¦
Their mistake is that the extended warranty was charged for $1300 and just alone that accounts to 1300/36= $36.11 a month not a $5 difference thatās what I told them to fix that and we will come and sign the contract but they donāt want to do that. They want the car back and try to keep the $500 deposit so hence the whole issue.
