Totaled after 2 months. What to do?

The one case where you can rear end someone and not be at fault is when someone takes your right way. Happened to me once, snowy road and somebody in front of me started fish tailing and ended up in my lane with no time for me to avoid hitting him. The other driver was at fault and his insurance totaled my car, leaving me with a decent check.(not a lease)

What about if person you Rear Ended has broken Brake lights?

They get a ticket for a defective vehicle and you still get a ticket for hitting them
