Someone backed into my newly leased EQS. What to do?

Someone backed into my EQS and I called the cops and we swapped information. Is there any consequences for having a very minor accident? I haven’t called MB yet or my insurance because it happened at 1 am last night. Is there anything special that you can recommend for me to do? I assume I would take it to my local MB dealer for them to fix it and get a loaner. If I don’t like the loaner or it’s not as expensive as my car am I allowed to ask for something better?

Looks like it’s only the taillight housing and no body damage correct?

This exactly happened to someone I knew on a BMW lease a few years ago.

Make them pay for a new taillight housing and you can prob replace it yourself in under an hour. If you’re not mechanically inclined to do it yourself, pay a third party shop to do it. It shouldn’t really cost that much as it’s only a R&R. It’s literally held into place by 2-3 bolts and there’s generally 1 plug.

Will be cheaper for both parties rather than trying to make a claim and pay a deductible over a tail lamp assembly.

I cant tell but there might be a bit of damage on the bumper

I was thinking about doing that but I’m scared because the bumper is out of place a little bit and I’d be worried if I did that the screen behind the steering wheel says left tail light out wouldn’t be able to fix it.

I would notify MB as required by the lease, and get in touch with the other persons insurance company. That company should be paying for the repairs and a rental car while yours is being repaired.

You do not need to take the car to your local MB dealer for repairs, and I doubt they will give you a loaner. The Insurance company will probably not pay for a rental of a car as expensive as yours.

Why would OP notify MBFS? Makes no sense to me.

If the other person’s insurance is paying for it why wouldn’t I take it to MB? They give out loaners rather than some random rental car.

If you end up fixing it, make sure you take it to the authorized MB body-shop, and get it fixed there, unless it’s not reported on carfax (which then you can likely replace the tail light yourself). This would reduce your risk of getting charged, when your return your lease.

First of all it’s a lease so don’t sweat it. Whatever happens to the carfax and depreciation isn’t your problem.

Contact their insurance and file a claim and they will either send out an adjuster or have you go to a body shop and they will handle repairs. Make sure the repairs look fine before accepting and signing off on it.

There’s no need to call your insurance since you are not at fault and it’s not a hit and run or uninsured driver.

I don’t know the contract specifics but if it says contact MBFS then do that too.

You should ask for their insurance to cover a rental car. All you are entitled to is a vehicle with four wheels but often they try to match up type of vehicle so they won’t give you an Escort if you had a minivan. But don’t expect anything nice. When my G63 had to get a bumper fixed they put me into some econo crossover from Enterprise.

There is usually a contractual requirement to do so.

Is that only if it’s totaled? I don’t see why MBFS would want to know about every accident.

My CCAP lease only speaks of notification if it is a total loss. BMW has any accident.

If the guy backed into you then it’s his responsibility. File the claim with your insurance carrier and tell them to subrogate the claim so they deal with his insurance carrier. Your carrier should send you to a certified repair shop for the repair in case there is damage as you suspect to the bumper. If censors are damaged and need replacing then it easily gets into multiple thousands. Don’t take any chances or shortcuts especially since it’s not going to impact your insurance.

You are so right. I tried to get a Mercedes loaner if I did body work through them but I would have to jump through hoops to get one. The person who hit me insurance says that they would only cover getting work done through a body shop that isn’t Mercedes benz because they said that they charge for stuff that isn’t even wrong with the car and that they take too long to fix it. Did you have this problem as well?
