Imo seems like the dealer is an idiot and a liar, op is an a**hole scumbag, surfer is an ethical professor who has done nothing wrong in his life and is preaching the “good fight”, and those two lawyers made out like a bandit. No wonder being a lawyer is so much more profitable than a doctor or engineer in this country.

Actually OP “literally” exercised his legal right to participate in an open contract of a solicitation of an offer to buy. A legally enforceable and binding contract upheld by contract law.
One of the purposes of these contract laws is to protect the public from false advertising exactly as described in this case. The binding nature and legal enforceability of these invitations to buy act as the deterrent against false advertising.
It would follow that every time a deal like this gets legally enforced it further protects all that come after.

When you’ve been leasing for so long you find that dealers will almost always advertise something but when you come in, they give you something totally different. I guess it depends on how bad someone wants the car or for whatever reason. MAYBE this gentleman just so happens to want this specific car and maybe he wanted to do something about it and hold the dealership accountable. Everyone is entitled their own opinion. Also everyone in entitled to do what they want with their time.
I mean, he pulled a little muscle to get a really good deal. I see nothing wrong with it, if the dealer wants to say that their deal they are advertising on their website is invalid, then keep advertising it after stating so, they should be punished. Besides it’s not like it’s the lessee’s fault. He’s just leasing his car at their advertised price with no incentives, kudos to him.
Love this thread. Way to hold this stealership accountable. You should report this to your local news outlet as well, maybe they will do a small story about this and scare some other shady businesses from these types of practices. Bravo

Surfer did not know Mass. consumer protection laws prevent companies from advertising and a legal binding to honor those ads with exceptions for date and genuine lack of supply. Lazarus questioned it, I posted it, and retracted it to DM it Lazarus instead, Lazarus deleted his response, and I deleted my response.

- The store must honor the price in the advertisement, even if it is wrong, until they correct the misrepresentation using the same advertising medium and/or by corrective signs in the store.

I posted a response to hershey’s message but deleted it in favor of a dm (asking why it was deleted).
It’s one thing to file a formal complaint. It’s another to threaten litigation.
This sounds very similar to stories of people seeking out non-compliant ADA examples and threatening to sue to make a nearly guaranteed $20k. Does not make for a small business-friendly world, despite the fact that some dealerships deserve it.
Honestly, my initial reaction was of regret over a missed opportunity to score a sweet F-Pace deal back in December from a similar bait n switch. But reading this made me rethink my ethics.
