Has anyone successfully recovered sales tax from NJ using form a-3730 for a lease that was terminated early or transferred? If there is anyone out there with experience going through the process I would definitely appreciate some insight.
I tried and was denied even on appeal. Curious to hear if anyone was successful.
can you share the specifics? did you transfer the lease, was it totaled, did you trade it in, etc?
I spoke to someone in another NJ Tax division and she flat out said “they won’t give you back your money.” Stereotypical gov’t worker attitude so I didn’t press much. She just said to fill out the application and submit it.
I transferred it. The told me I couldn’t “read the letter of the law” only their translation of it. I thought about appealing it to court but Covid hit.
Were you able to speak with anyone live during the process or did you only receive communication in writing?
This document specifically states the lessee is entitled to a refund

I had two hearings over the phone. I read them the law and they said they don’t agree with it. It sounded like their mind was made up. I even asked for them to give me an example of how anyone could get a refund, they started talking about lemon law and trade ins on purchases.
Thanks for sharing and I’m sorry to hear you didn’t have success, it sounds like a complete shit show.
Easy for them to take that stance when they already have the money.
