I leased my first Mercedes on June 26, 2018 for 36 months. Fast forward to July 20, 2020, I turned in the vehicle 11 months before the lease end date and paid a lease turn in fee of $4,600 to get into another Mercedes vehicle.
On July 22, 2020, I pick up my new Mercedes financing it this time. Which I paid it off completely in June, 2021 as I sold it.
Now on November 6, 2021, Mercedes Financial sends me a lease end statement for the first Mercedes after 1 year and 4 months I turned in the vehicle charging me for excess mileage $236 and vehicle turn in fee of $595.
I just got off the phone with them and the rep stated in order to qualify for the wavier of the lease turn in fee, I need to get into another Mercedes Vehicle within 60 days of my turn in date of the previous vehicle. Which I stated, “I did, 2 days later…”
Then she proceeds to tell me since you ended your lease early, you are not eligible for the wavier. Which make zero sense considering I paid $4,600 to terminate my lease and regardless it shouldn’t matter when I end my lease if I get another car from the same brand. Neither have I found this being stated in their terms.
I told her to take this case to someone up the ladder and I am expecting to hear back from them. I am seriously considering taking this to court if they don’t wave it. Anyone been on the same boat?
Your logic is convoluted. Yes, OP wanted to get out of lease early and was ready to pay 4.6k for this. It makes perfect sense for OP to do this and not wanting to pay extra random 800. Why is it a surprise for you?
Then they shouldn’t charge you for disposition fee as long as you show them the new contract. Overmileage is something that is billable because the dealer might have taken the vehicle on Lease Return rather than buy it
She even saw the new contract herself. I have no issue paying the excess mileage fee but I’m definitely not paying turn in fee. That’s why I initially got out of the lease early because within 2 out of the 3 years I ran out of miles, 30k. I didn’t want to be paying what would be an equivalent of an extra $300-$400 a month on top of my lease payment of $420 for excess miles. It would cost me the same to get into another vehicle and that’s what I did. I just hope they don’t ruin my credit because of this while I am trying to get this resolved with them as there is a due date.
Talk to someone up high in the ladder and tell them you will take them to Court . You should not be paying that fees. Their defense will be show it on the contract not to pay the fees if you buying a new MB. Not sure who eats up that fees the MBFS or the dealer selling you the new Benz.
Perhaps this may work, but I would just say to be careful with this tactic. From my past experience, if you so much as mention a whiff of ‘court’ or ‘lawyer’ to BMWNA, they clam up entirely and pretty much only give you legal’s contact info from thereon out - maybe MBFS is different.
You paid $4600 as an early termination fee to avoid paying $300-400/month in excess mileage costs over 11 months…which is $3300-4400!!! I guess that might make sense if you also needed to replace the brakes/tires…but my experience with MB is that they need replacing well before 30K miles.
I hope you got 15K/annually on your new lease, or you’re going to be in the same boat a year from now!
