GM Financial wants a disposition fee 6,5 months after my GM dealer bought the car I returned to him at the end of lease?

Hi folks,

I’d like to get clarity on that: My GM dealer directly bought the Chevi car off from GMF he told me when I returned the car to him on February 20, 2019.
He told me that GMF will not charge me with anything, since he bought the car and GMF has nothing to do with it any longer.

A few weeks later I got a letter from GMF stating that there are no remaining charges for me (I have to dig up that letter for providing more details, but I am 1000% sure there were no charges listed there).

Now, dated 9/9 - 6,5 months later ! - I received a letter from GMC confirming that I don’t have to pay charges, but all of a sudden a Disposition fee of $395 plus tax ?

This is ridiculous, since GMF had NO work at all with selling my leased car, since the dealer payed them off right away on February 20, 2019.

Your thoughts?
Is GMF correct, means do I really have to pay that fee, or is it worth to dispute that?

Was does your lease agreement say?

I haven’t digged that out yet. I signed that back in Nov-2016.

It probably states that I have to pay that, but - I mean, come on - if they had NO action at all on their side for selling the car, what’s the justification then for charging me with that ?

Not to mention: 6,5 months after I successfully returned the car? That’s weird IMO.
No matter what, that long time period sounds weird to me. I know a bunch of folks that aren’t even in the US 6,5 months after their lease ended successfully, so what would GMF do then?!?

You agreed to pay it, and then signed a contract that stated such.

You can’t sign a contract and then decide three years later that you don’t want to honor part of it.

Got that. But the contract usually states that this is within what, 4-6 weeks?
Not 6,5 months later.

Also, it might be the case that this disposition is not charged when the dealer buys the car, what’s the case for me.

Never heard you can get out of disposition fee unless you lease another one with same bank.

Only if that is what your lease agreement says.

Is that usually called out in the contract?

I haven’t had personal experience with GMF, however, with all of my leases that a dealer, or 3rd party bought the vehicle prior to lease end, I have never received a bill for disposition fee.

Contacting GMF should be your first step.

If it doesn’t specify a timeframe, look up the statute of limitations for written agreements in your state for how long they can collect.

Will they sue you for $395? Probably not, but if you owe it and refuse to pay you are very likely looking at a serious delinquency on your credit report for the next 7 years.

If it goes to a collection agency, you’ll probably have a second derogatory trade line on your credit reports for the same debt.

Seems odd. he disposition fee is generally calculated in the pay off amount when the dealer, or anyone else buys out a lease. I am getting ready to turn in a GM lease (Cadillac) and I have my buyout which includes the disposition fee

Did the dealer actually buy the car? Again, what’s the contract say? What did the dealer provide you in writing regarding your prior car?

Yes, the dealer actually bought the car from GMF. He assured to me that I am fine, nothing will come afterwards.

Oh well if the dealer said so then it must be true.

Apart from that: GMF said so as well! In their final invoice they send me 4-6 weeks later, an additional fee was not listed at all. But now, all of a sudden and 6.5 months later (?!?) they want to have more money? Very obscure in my mind.
