Exploring Recourse. Dealer Altered Lease Contract and Reduced Mileage on Lease Contract

Hello Fellas,

I need advice on my options. I’m confident the dealer altered my Nissan Leaf lease contract before submitting it to NMAC.

  • leased Nissan MY23 in January of 2023 for 12K yearly / 18K total for 18 months
  • I called NMAC few month prior to maturity as I noticed online NAMC indicated 10K yearly / 15k in total allocated miles.
  • NMAC stated that the contract on file lists 10K/y while my copy of contract lists 12K/y. NMAC advised me to reach out to dealer to sort it out
  • Called , texted and visited dealership to get hold of F&I. He was always unavailable, responded to text that he is busy with clients
  • 4 months forward, I ground the lease and bring this concern to GSM. He says he will look into it and get back.
  • 2 weeks later, I draft an formal email to GSM (no communication from him in meanwhile), attach lease copy dealer gave me and what NMAC account listed.
  • I finally got a call, which quickly became contentious. The GSM asked, somewhat agitatedly, what I wanted. I mentioned financial compensation, but he dodged my request to confirm whether the dealer was at fault.
  • Now, I’m posting here for advice while I decide on my next steps. For now, I’m withholding the dealer’s name. I may pursue for wire fraud / signature forging etc… but I prefer to just recoup some money (I had to make payments and insurance for another car 4 months earlier due to out of miles and make payment).

P.S. this is repost of what I shared on reddit in devil’s dungeon. Since that post, I have contacted Nissan Consumer affairs, but they are not providing any recourse, only apologies for the inconvenience. Nissan has lodged formal complaint against the dealership (not sure what they mean?).

You have a signed copy of your contract showing 12k miles per year?

if you show a signed copy of your lease / buyers order that shows 12k miles, all you have to do is send that in to NMAC. They will work this out w the dealer. your situation sucks.

Escalate it. Once the deal funds, it’s no longer a you vs dealer issue. Yes, the dealer screwed this up, but the contract is in NMAC’s hands. It’s a you vs them issue now.

The max cost of this issue to you is 3000 * $0.15=$450 in total right? Why did you have to get a new car 4 months earlier?

It’s not worth going to court for this. You should be able to hash this out with Nissan as others suggested.

That really sucks, but yeah, get on the phone with NMAC, send them your contract, and put the ball in their court. You have a signed contract for 12k miles.

If you grounded the lease before the lease term ended, then why does the mileage allowance matter?

That is good because they can’t. They would have to arbitrate without the benefit of any state consumer protection law.

Shot in the dark but it is possible NMAC has knowledge of some ongoing pattern of fraud at this dealership including a possible criminal investigation. In which case there might be some stuff going on behind the scenes that limit what NMAC can tell you/do for you now. This might have been an accident but if it was not this doesn’t seem like the type of fraud a dealer just does once or twice.

Contract forging/defrauding/doctoring/adjusting influenced* me to get replacement sooner than anticipated.

As I mentioned on reddit, this dealership, a known franchisee in my regional market, targets subprime borrower. Their dealerships are predominantly in black and hispanic neighborhoods and that is the clientele they target. Subprime borrower are usually payment sensitive and struggle to read fine print. When I called out their BS. their response behavior is appalling but sadly not surprising.

For context, lease was grounded in August. I made complaint with Nissan Consumer Affairs after failing to workout with dealer.

IMO, you should just let it go. Nissan will honor the original contract but it won’t make a difference for you because you stayed under 15K miles. The dealer will argue that it was an honest mistake and I don’t see neither Nissan nor the dealer giving you any financial compensation. Feel free to talk to a lawyer but I think you will just waste your time and money.

Yeah unless you specifically had to pay an over mileage fee it’s hard to see what you could ask for. Are these people scum bags preying on the ignorant? Yep! Can you get them for it? Probably not.
