Confused about broker/dealer lease process

Your personal information is everywhere. The 2 brokers I’ve leased cars through on this site are trustworthy and reputable. You can always ask the broker to delete the text message with your information. You can send it written out.

I disagree with your general “legal” opinion on the matter of liability for the site…

That said, I agree that I don’t need peoples personal info beyond the basics to setup a deal and get a proper tax quote.

This is why I have my clients submit credit directly to the dealer, and if the dealer wants a paper app, I specifically attach it and tell the client to return it to the dealership privately.

I don’t like even the idea of having an unintentional collection of credit apps, because of the liability, and it’s just generally none of my business, so that’s my process and I think customers appreciate it.

That said, I still don’t see this site being liable for other things. I think they’d take on more liability if they do what you’re suggesting and make their own secure doc and payment portal, most importantly, they go from essentially a third party who people freely meet other people on to an integral part of the process and directly involved…

Woah Woah Woah, that’s a serious allegation. The brokers I’ve dealt with never asked for anything other than zip codes. If your broker is asking for SSN, that’s an issue IMO. DEALERS need the credit app with includes SSN but brokers can’t approve credit. And this is coming from a Landlord who has an in house application process (I take SSN, ID, etc) And I’ve been audited by my partner company who does the background check.

From a personal standpoint, I would NEVER give out SSN to any sort of broker. That includes real estate agents too lol.

Normally not a cause for concern as most brokers act in good faith

I’m glad to be proven wrong but I don’t think a broker should be getting any sensitive info like ssn at all with the exception of special circumstances (a dealer not applying loyalty because they didn’t see the registration). I mean why does a broker need it? Passing on information like reg and ID is normal though

None of us need that info in a literal sense to quote a deal, but some will collect a credit app directly as part of the deal package (which some dealers want to include an already complete app on broker deals), and as a consequence, end up with it.

All of the larger brokerage companies on here I’m confident do it in a compliant way if they take their own apps, but that’s just the answer to your question.

I just personally don’t, because as I said, I don’t even like having access to it, I don’t want access to it. Last thing I need is someone sending me a credit app, then 3 months later their card is hacked or something, and now I’m somehow in the mix of people who had their personal info, and all for nothing really.

I mean a broker doing credit apps seems to be a bit risky IMO for both the broker and customer. All the brokers I’ve worked with are on the smaller side so no credit app needed by broker.

@IAC_Scott has the right approach because it’s not as simple as that and keeping it away from you as far as possible is what you want.

Also, sharing clients information (including name, phone number, email etc) without expressed consent is an issue. Ever notice there’s checkboxes for that?

It’s not that serious but if some sort of personal info like your income, job, title etc is being shared and then shared with others saying “don’t work with this person”. I’m not saying my SSN was shared but some other details were def shared. I don’t care for it anymore but since someone brought it up so I said something

Are some of them sharing State ID’s with each other and then passing that info to some members on this forum?

Pretty sure that’s not allowed without consent

Question is are some “brokers” passing material information to other brokers and other people on or off this forum

Are we free to not do any maintenance without any penalty? If no, then put it on the contract.

Maybe, I don’t have proof of physical evidence but I do have proof of brokers talking within themselves about people’s background info.

Are we talking about brokers saying “hey everyone else, watch out for John Smith. They inquired with me and wanted to use a Montana LLC at the last minute and didn’t disclose it” or “hey everyone else, John Smith lives on Mulberry lane. If you’re driving by, be sure to tell his wife Mary she has a 600 credit score”?

I have no inside information, haven’t seen any messages, etc.

I picked those two as examples because the former would be a not unreasonable conversation to be had.

“hey, so and so wasted my time by not disclosing this potential tax fraud, watch yourself if he reaches out to you” isn’t a surprising conversation, nor is it sharing anything protected.

“Hey, here is some detailed personal information because i don’t like this guy” is a hugely different thing and very much inappropriate.

Again, Admins won’t do anything to brokers on here since they pay them to be brokers. @Dany1122 clearly has more intel on this than I do.

@BlameMeLo - As others have stated, a broker should not be asking for your social security number. However, I don’t see anything wrong with them asking for a copy of your driver’s license as long they are using it to verify your identity and state of residency.

At the end of the day if you don’t feel comfortable sharing any personal information in a non-secured manner then don’t do it.
