My leased car got sold illegally while I’m still under the lease terms

Yea, recently saw something similar happen, probably just someone mistyped.

Is the friend added to the insurance policy? If not, IANAL, but the above sounds like 2 completely different situations.

I assume that, if you were to let a friend borrow a car for a few months and said friend got into an accident and the insurance company somehow discovered your friend had been the unlisted primary driver for a few months, that would be a problem.

W/ a lease or a rental, I assume that the contract and a lot of legalese make it clear (and “routine”) that you are the person responsible and are expected to have insurance (and this is intuitively logical, as well).

And if you are assuming that the friend is added to the insurance policy, the OP’s situation still sounds… unique.

It can happen. My 3 jeeps I got last year have all same VINs besides last number.

It is called insurable intrest. Either you have it or you do not. If you do not (you do not own the thing being insured)- claim will most likey be denied. So you can pay for insurace, but when it come down to it- you do not have insurance. It will be part of any payout investigation.

This is what stops me from buying insurance on your home and filing a claim against it. You cannot get an insurance payout if you do not have insurable (ownership) intrest in something.

Adivse to run to another carrier and not disclose is really bad advise. Please do not listen to internet advisors that are guessing on how things work.

I have no idea what advise to the OP- but insurance fraud is not the answer out.

My vote goes to fat finger as well. OP hopefully everything will be resolved for you soon.

And if you are leasing a car that you are in possession of, you have an insurable interest. Even more so since the lease specifically requires you to have insurance.

The fact that someone else claims to own the car should not affect this. GM could sell the car, but since you have a valid lease, you would still have an insurable interest.

We got fat fingered on a mortgage application many years ago. My wife’s SSN was one digit off on the application. Several years later we received a notice in the mail that our mortgage was covered by a bankruptcy plan. We initially ignored it, since we thought the lender was trying to sell us something. We later found out the person with the SSN that was erroneously listed on the mortgage application had filed for bankruptcy. It was a pain to straighten it out.

That’s what I implied, but why you replied to me instead of OP? lol

sorry to OP- replied on the wrong link

This is fascinating.

Same H3 you had listed in Private Transfers at the beginning of the year, I assume?

Any virtual tire kickers ask you for the VIN?

Update and yes it is the same Hummer that was up for private transfers a while back. Confirmed it was fraud and not someone fat fingering the vin. Insurance says they will cover it unless CT DMV drops the registration or some one else claims ownership. GM Financial sucks big time as they are saying keep paying us and we will look into it but we have the title here so no one bought it from us. Local law enforcement took the report and told me to tell DMV so they could start their own investigation in case it were ever reported stolen. And GM financial also said that I could turn it in and hope that it was worth more at sale and I might not owe anything which is such BS because the purchase process is 94k on a 64k car at current value. There isn’t much else to be done but im just pissed that they won’t just eat the last 8 months remaining and let me turn it in it so I don’t have to deal with this BS and unless someone has a last ditch miracle so I get out of this mess to unload the car I’m gonna have to deal with it.

Well… looks like you can just drive it off until lease end.

Is that a bad thing?

To be fair, if your insurance company is covering it, your local law enforcement agency has taken notice and advised you to alert your DMV and GM Financial has told you that they have the title in house and they plan to keep it in house, then what’s the issue with just completing your remaining 8 months ?

Look at things from the other side, The dealer who bought the car from the scam company is probably fighting the case through his financial institution and law enforcement options. At this point, they dont have a title and they realize that calling you wont really help their case. The only option they have is to go after the scammer and not after the rightful owner of the car which is you.

What are we missing ?

You are missing the fact that he (edit: she?) tried to get out of his/her lease since the start of the year lol

Not missing anything at all, I was just hopeful that, based on the craptacularthis is, they would be kind and let me out of the remaining few months so I could save the money and move on. Yes, wishful thinking, and yes, not realistic, but hey, a girl can dream.

Ahh ok makes sense. Well hopefully things go smooth for you from here on for the next whatever time left with this ride.

Who would have guessed that?

What is the personal property tax bill on that Hummer EV in your town?

$1800 a year

Why would a dealership in FL buy a car they cant get a title on, the title belongs to GM Financial, they wont release it unless they are paid in full.

The dealership in FL messed up and is s*** out of luck.
