California lemon law is pretty clear. If the car is at the dealer a total of 30 days (doesn’t have to be consecutive) for the same issue or a fix has been attempted for the same problem “a reasonable” amount of times, you may be eligible for a lemon law case.
It’s always recommended to consult with a lemon law attorney if you believe you have a case.
One thing you want to be careful of is (Bolding mine)
Unless the buyer agrees in writing to the contrary, the goods shall be serviced or repaired so as to conform to the applicable warranties within 30 days.
Do not allow the dealer to argue you consented to extension of the repair window beyond 30 days, as that’s the clearer path to eligibility vs. the more subjective reasonableness test.

They’re replacing my compressor as well. The AC on mine worked fine, but it caused significant vibration and noise inside the vehicle, which they said was not normal. I don’t care because I got another EQS as a loaner so I’m saving on my mileage allowance.
So far we have stories of
A) 12 v sensor and or battery management circuits failing
B) HV Battery failing due to impact with a road hazard
C) Front motor failing
D) AC compressor failing
E) multiple recalls for propulsion systems
Is there any part in this car that’s not gonna fail prematurely? The windshield wipers perhaps?
I was cleaning the tires today and realized my 22’’ Pirelli PZ4 are NOT run flats. There is no indication on the sidewall and these look like regular PZ4 Sports, with MOS (Mersedes original silent). I have a compressor and foam in the trunk.
So, for lease return - could I just buy cheapest lionheats with the same 102H rating and call it a day?
Which EQS do you have? I had the first three done a couple of weeks ago. Was just told that the last one doesn’t apply to my vin. At least, not yet… I have a 2022 450+ sedan.
@David_Anthony how exactly do in shop days count? Meaning, if I dropped the car off on the 11th and picked up on the 19 the, it’s 9 days, right? If that’s the case, then I’m almost 1/3 of the lemon juicer full .
I’ve been waiting for a company to push back against a lemon law claim with a pure EV that is so heavily dependent on computers. Remember it has to be 30 days for the same issue.
If this really becomes a problem MB can go two ways on this, fix it or fight it.
It would be super easy for them to identify a specific operation process or control and call that the problem, thus making it very easy to change whats wrong each time. I doubt that MB would go that route but it is a possibility.
My 2022 EQS 450+ sedan was originally on the list for the drivetrain software recall, but was removed from the list on the website. The dealer did the update anyway.
