Lemon Law - Software malfunction multiple times despite “updates”

Anyone knows if malfunction of EQE multiple times due to software can be considered and filed a lemon? The car basically stops and shows multiple warning messages for a while. Happened many times in the last 3 months and Mercedes did the “software update” thrice but not fixed yet.

Dealership telling me software isn’t eligible for lemon.

Car been at service for 25+ days so far

Has to be in shop 30+ days also

In most states, its x amount of days or x amount of attempts for the same issue.

Shut up and don’t say anything to the dealer. I REPEAT STFU TO THE DEALER. STFU STFU STFU! THE DEALER IS NOT YOUR FRIEND. If you’re in NJ call a lemon law attorney asap. They’ll get the ball rolling. You don’t need 30 days in NJ. It’s 20 days in service for NJ.

In NJ you need a certified letter to Mercedes giving them one last opportunity to fix so yes you have to notify them first before initiating legal route

Or you can bypass that with a lawyer. A lawyer can bypass it and send it straight to the manufacturer. My suggestion is to get a lawyer that specializes in lemon law. Once the manufacturer gets the documentation, they’ll basically either send you an offer to settle or arbitration. If they don’t give you an offer, and arbitration was appealed, then you go to court. I did it twice in NJ.

Did you win and what was the outcome? Did the manufacturer pay for the lawyer?

I’ve done it , and yes they pay them money and paid me money too (car was too old to take back)
My whole total participation was

  • Send them lease docs
  • Send them repair docs
  • Answered 2 emails
  • Sent 2 signed docs via email

And I ended up with some money. (And lawyer did too)

Edit : In no case did I contact the dealer who was fixing my car. Other than picking up my fixed car DURING the case. lol

They took care of contacting, demanding reparations (money in my case), and sending all required paperwork.

So I’m under NDA since we settled. And yes the lawyer is free for you since Mercedes pays for it. But your lawyer will make you sign a contract telling you to STFU with the dealer lol.

Mien was similar. It was.

  • Send them purchase docs.

  • Send them repair docs

  • Discuss with lawyer what my ideal plan was (buyback, money, or a trade)

  • Go to a 15 minute arbitration

Wow! yours went to Arbitration, it must’ve been some serious $$$$
