Expired Tags, Car Impounded, Dealer MIA

I got the i7 back in December, rolling in my negative equity, so everything seemed fine. My first set of temporary tags expired in January, and the dealer claimed they couldn’t issue another set for some reason. During that time, I got pulled over for an unrelated offense, and the officer noted my expired tags, resulting in the car being impounded for about eight days. After pleading with the dealer, I finally got another set of tags. YES, I came out of pocket for that since dealer said “not our fault”

However, the dealer didn’t even submit the paperwork to the DMV until mid-February. A DMV agent later called me, stating that the paperwork showed the vehicle as a retail loan purchase instead of a lease. When I confronted the dealer, they dismissed it, saying, “That’s between you and BMWFS now. Your deal is funded, and we don’t own the car.” I found that to be a weak excuse for avoiding responsibility.

Now, my second set of tags has expired, and a cop warned me that if I get pulled over again, the car will remain in the impound lot until I have physical plates and registration in hand.

Then, out of nowhere, I received an email welcoming me to the BMW family. I assumed this meant they had restructured my contract from a loan to a lease. Instead, I discovered that they added a 2024 BMW XM to my BMWFS account, which no one—including the dealer—seems to know anything about. So now, I have:

  1. A BMW i7 that I can’t drive due to expired tags.
  2. A mystery 2024 BMW XM under my name that I never took delivery of.

When I spoke to BMWFS, they confirmed that it’s the dealer’s responsibility to correct the paperwork before BMWFS can process any changes. They also mentioned that if the dealer fails to submit the title within a certain timeframe, they can cancel the loan and unwind the deal—which would be ideal. However, the issue is that my trade-in (the Grand Wagoneer) has already been sold, so the dealer can’t return it to me.

I emailed the dealer 10 days ago and have yet to receive a response. Meanwhile, both BMWFS and BMWNA see the XM under my account, but there’s no attached paperwork on the deal.

My Question:

How much leverage do I have to force this deal to be unwound?
The DMV agent told me they can return the paperwork and have it resubmitted, but it would restart the process and take another 8 weeks. What are my best options here?

A solid lawyer familiar with automotive law would be my suggestion, consumer protection law as relates to car dealers is pretty strong in many states

Wouldn’t you owe them the negative equity if they unwind the deal? Unless they showed zero negative equity on the deal and less dealer discount one the new car for some reason.

Yes but I even offered to move to NC since there will be no sales tax since I traded in a car. Dealer said “not our problem anymore, you can deal with BMWFS to get whatever you want corrected”

If all this is accurate I’d try to find a grimey lawyer on contingency to sue everyone

Yeah but is it worth all that hassle? I low key should have just kept the POS waggy. At least I was getting paid to drive that one at the end of the day.

BMWNA got involved and said we cannot force dealer to do anything but we can offer you $2500 rebate towards next car to cover impound fees and the 2 months of not able to drive the car.

Not sure how that is at all useful and why BMW would be OK with a dealer and not properly funding a deal. My first step would be a strong worded email to every single employee at the BMW dealership you can find that if this deal isn’t properly done by weekend you’ll be perusing legal action

Yeah I have a email drafted but my local BMW F&I guy told me, usually BMWFS will start ruffling feathers after 90 days if there is no title on file. Right now I am just dealing with the minions of BMWFS but once that 90+ day passes that is when upper management has to get involved.

Where is the MSO of this car? Is there such a thing called private tag agency in NC? Try to get the MSO from the dealer and go to tag agency yourself.

I was well over 100 days getting plates on my BMW IX. BMWFS didn’t seem to care one way or another. Running a carfax can be helpful as the records update incrementally. You just need to figure out how to make it right with your DMV. Perhaps you can rent a dealer plate while waiting.

DMV has paperwork but dealer did paperwork incorrectly so they cannot move forward with registering the car till it’s filled out properly.

They put me as full owner of the car when it should be BMWFS as lessor

If the DMV has paperwork showing you own the car, why did they not just issue registration in your name only?

Cause bmw owns the car since it’s a lease. It’s contradicting paperwork
