Dealership screwed up security deposit, wants me to pay more. What should I do?

So I got a car from a manufacturer that rounds the MSD payments up by $50 per monthly payment. Due to a mistake by the dealership, they sold us a car with a wrong MSD payment. So essentially what they did was they rounded up the lease payment AFTER the MSD rates were applied. So essentially $500 x 8 instead of the original $450 x 8 which is what they told us at time of purchase.

Its only $400 dollars more, but the problem is that they also want us to drive all the way back to the dealership and sign all the paperwork and its a pretty long drive from my house.

I feel like I’m being inconvenienced because of their screw up, as well as having to put more down than I originally thought.

Anybody have any ideas or been in a similar situation?

It is an honest mistake it seems. If they want you to increase the MSD amount, that seems reasonable as that is set by the manufacturer.

Make sure to check and double check the paper-work.

Have them FEDEX the paperwork. Their mistake not yours. My friend’s wife got a new Prius and they forgot a form for her to sign. Since the dealership is over 2hrs away they wanted her to come in and sign. Since it was their mistake I told them to FEDEX form and she will sign. At first they were reluctant so I told them she would just return the car since they did not complete the lease contract. A day later the package arrived her house.

Its happens and mistakes suck. Depending on the deal sometimes they will eat the difference. I had to do it once… :frowning:

One of my friends had issue 3 yrs ago with a genesis lease paperwork. Even though dealer was 20 mins away, friend was pissed. They offered maintenance through out lease and excess coverage till 5k.

If you got a good deal and dealer was pleasant to work with, I’d just drive there, re-sign the paperwork and pay the extra MSD amount. If they are too far away, ask them to FedEx the paperwork. If they turn that down, then make them have someone drive and deliver the paperwork to you.

Honest mistake, just ask the dealership to send someone to your house/place of business to get the new signatures and the check.

And if they do send someone, make sure you double check the paperwork. Make sure no other changes to mileage ir etc.

I had a BMW dealer require me to resign. That said I was in another state so they fedexed the docs to me along with the return envelope. No sure how far you are from the dealer but they will probably send you the docs to sign.

Thanks for the tips, I’m going to most likely just get them to fedex me the paperwork… I think they’re being lazy trying to get me to go in lol.

Just to satisfy my curiosity. What would happen if I refuse their new contract and ask that the original be enforced? Could they then break the contract? I’m not a lawyer, but to me it seems like just because they’re a dealer it doesn’t make a difference. They have to follow the contract the same way I would. Right?

They could cancel contract based on time. In CA we have 10 days to send a letter of Cancellation. Every customer signs a form acknowledging.

The dealer isn’t cancelling the contract. The captive rejected it. If the captive rejects, the dealer still owns the car, and doesn’t get paid. The dealer made the mistake, yes, but it’s the captive that rejected it.

If you look thru it, it probably says it is contingent on the lender accepting the contract. Otherwise you unwind, ie return the car etc.

Just like the others said, it sounds like an honest mistake. If you want to keep the car, you’ll have to sign the new documents. There should be no reason that they can’t come to you with the documents though, just let them know that you’re busy and won’t be able to drive out to them. You could also offer to meet them half way too, if that would be an option.
