This happened to me with a 330e, it was during the pandemic and they put a stop to the transfer. The car sat at the dealer for 3+ months, I was about to lemon it but they finally got the parts after 3 months and I sold it a week after I bought it.
If you just want your money back, drop it off at the dealer to get fixed and then get it lemoned after a month of sitting at the dealer. at least thatâs how I believe it works in CA lol
I took the car in service yesterday for oil change and they said the car itâs safe to be driven even with that open recall. But sales and lease transfer are stopped.
They still donât have an ETA on the recall parts.
so its safe to drive but not transfer? Sounds like BS to me. I think the dealer doesnât want to give you a loaner
The funny part is I donât want/need a loaner (this is my 3rd car now)
I would be OK for them to keep the car in service because BMW HQ will refund my lease payments for the time car staid in service
I was at stage 2 of a transfer with title ordered by BMW. I slapped with an integrated brake recall from BMW. I donât even think they have the part to fix it. Buyer needed a car bad so he backed out. Sucks for us.
Not sure how that guy above got his car transfered with an open recall. Iâve had a simple recall before and couldnât even initiate a transfer. Anyway good luck. Iâm also transferring a car for your same reasons. Stick with Swapalease.
Recall is pretty serious which is why they are not allowing. I had a similar issue with my M8 in 2021. Luckily werent many left on SAL and buyer wanted the exact color comvo i had so waited a month.
The current one is the braking systemsl which effects X5 X7 and XM and other models too. 2 months, no fix yet.

Carvana just picked up mine 3 weeks ago and of course overpaid.
I left my car in service after I asked them to confirm the car is safe to drive. They said they cannot do that and itâs better to keep it there until they âfixâ it.

The clock starts ticking once they have your vehicle in their possession. Obviously you may want to consult a lemon attorney⌠but assuming this is the only issue youâve had the rule is:
If the vehicle is in and out of the authorized repair shop for repair of one or more different problems for 15 or more cumulative days, the consumer must give written notification of this fact to the manufacturer (not the dealer), by certified, registered or express mail. Check the warranty book or ownerâs manual or other written manufacturer supplement for the address given by the manufacturer. A Motor Vehicle Defect Notification form may used for this purpose.

And then after that theyâll have a reasonable attempt to repair or provide a replacement vehicle. Technically after 30 days you should be able to lemon it out. But as Iâve pointed out in the past, if your claim to damages is low, most automakers will just do a goodwill buyback or collateral exchange without involving lawyers. Nobody wants to deal with lawyers, and a buyback should be much quicker/cheaper to resolve once youâve hit that 30 day mark.
I donât know how that 15 day notice affects the goodwill process though.

Ugh⌠yeah a goodwill buyback often wonât pay back previous payments, so you may need a lawyer to try and get that month of value you lose when itâs out of commission. Although I believe the lemon process in most states doesnât require that part to be repaid.
I would assume itâs just based on current mileage used. Manufacturer would give you whatever stateâs lemon law demands. If they try to short change you on not refunding for extra lease payments they are asking to be lemon lawyered.
Yeah but most lemon statutes wonât require the manufacturer to refund for the lease/payments incurred while the vehicle was being serviced and unusable. IIRC most state lemon statutes donât even expressly require the manufacturer to reimburse costs if the customer gets a rental car; pays for public transport, or buys a bicycle if they needed a means to get around while their car was being serviced.
Itâs not like having a lemon lawyer automatically means youâll get those payments. But having a lemon lawyer involved can help to get the settlement to include those payments since they can be more aggressive and they know more about the statutesâŚ
But for sure the manufacturer wonât pay for stuff like PPF, tint, aftermarket exhaust, or customer-add-ons.
Yup. See if you can work out a cash and keep with BMW. Most likely they will just pay your monthly payments itâs been in the shop and call it a day
