2021 Nissan Rogue totaled positive equity due to trade in and down payment, who gets the overage?

When we refinanced our lease did. It was definitely included and all our leases appear on our credit report as debt based on the outstanding amount of payments on the lease and the monthly payment

IIRC, some mortgage investors have guidelines that allow a lease payment to be ignored if it’s within X months of maturity. No one should count on this being universally true.

I’ve made maneuvers in the past where I’ve driven a cash car for just a few months while I worked on a mortgage. Once the mortgage is complete, I sell the cash car and keep moving. It certainly makes obtains a mortgage much more streamlined when there is no car debt and none or little credit card debt. What’s little in my opinion? 2k or less on credit card balances.

I don’t mean to divert too far from the original post. I’m still hoping Nissan helps you because this whole thing stinks! Likely it might not work out the best for Nissan, what if the insurance company pays them less than current book value by a lot anyway?

I would keep digging. Surely there must be some way to extract your lost cash from the at fault driver … I would want to speak deeply with my insurance agent very carefully on the subject for any and all advice I could get. I would also attempt to consult someone in the field of insurance lawyering to see if I could discover some it of information that may be helpful.

This is a reason I like an actual agent vs straight to geico for insurance, although it’s not a save all. Some agents are better than others, but they can get me insurance with any carrier, including geico. The agent gets his fees from the insurance company and in exchange becomes my advisor a notch closer to my assets and liabilities.

I leaned here that lease payments don’t count if you have fewer than 10 payments remaining and that Nissan gives you power of attorney over their leases… That was really helpful…

When we refinanced I had a an inexpensive lease with less than 9 months on it, still counted if it will extend past the closing date of the mortgage. I am in another state which may account for the discrepancy but that lease was mentioned

There is nothing wrong with leasing a Rogue, I got a decent deal in a tough market last year

Does having power of attorney help with anything?

Typically the POA is for limited purposes - eg BMW gave me POA to register the lease in my state. However, they sent the title and the filled in registration form, so in theory I could just assign the title to myself …
